
The E-3 visa was created in 2005 as part of a free trade agreement between the United States and Australia. It is designed for Australian citizens who possess the education and skills necessary to work in the U.S. in a specialized occupation.
There is also the E-3D visa for dependent family members, and spouses can apply for work authorization.
The E-3 visa is granted for periods of two years and can be renewed indefinitely. However, applicants must demonstrate that they do not intend to remain permanently in the U.S. and that they maintain a residence in another country.
Requirements for the U.S. Company
Must be an existing company in the U.S.
Must have the ability to pay the prevailing wage to the H-1B1 employee based on the prevailing wage standards.
The prevailing wage is defined as the average salary paid to workers employed in a specific occupation in the geographic area of the intended employment.
Applicant Requirements
Must be an Australian national.
Must hold a degree or equivalent (work experience) in a specialized occupation.
Must have a job offer from a U.S. company.
Must occupy a position that qualifies as a specialized occupation.
