The H-1B program applies to employers seeking to hire foreign workers for specialized jobs that require at least a bachelor's degree or its equivalent.
A specialized occupation is one that requires the application of a highly specialized body of knowledge and the attainment of at least a bachelor's degree or its equivalent.
This can include occupations in fields such as information technology, finance, engineering, architecture, and more.
The H-1B classification has an annual cap of 65,000 new statuses/visas each fiscal year. An additional 20,000 applications for individuals with a master's degree or higher from a U.S. institution of higher education are exempt from the cap.
Additionally, H-1B workers who are sponsored or employed at institutions of higher education or their affiliated nonprofit entities, a nonprofit research organization, or a government research organization are not subject to this numerical cap.
